10/13/05 New Mexican tariffs on US apples, Pt.2

It's bad enough the Mexican government reinstated anti-dumping tariffs on U.S. Red and Golden Delicious apples late last month. But the U.S. apple industry is not happy with the way it was done&giving three a break, one as low as zero per cent, while most others must pay the full amount of nearly forty-five per cent. ARCHER: The exporters individually are having to do the very best they can in their own behalf, so many have made filings, but in this particular case, we had eight or ten companies, in addition to those who received a favorable rate that had their claims rejected. So they're quite frustrated with the system and with good reason. Jim Archer of Northwest Fruit Exporters says the tariffs are temporary, until a final ruling is issued by the Mexican Ministry of Economia. However, that is not the end of the fight for Northwest apple growers and shippers. ARCHER: Northwest Fruit Exporters has an on-going issue within the Mexican judicial system, and we received notification on September 26th that one of our appeals had been decided in our favor, and the matter will now be remanded back to the lower court for resolution. N.F.E. has filed for a trial based on the constitutionality issues regarding the investigation. So we're still alive in terms of trying to have a favorable outcome within the court system.
